Practice Areas

+ Appellate Law

We are professional writers. Our attorneys regularly appear in front of Kansas Supreme Court, Kansas Court of Appeals, and the Tenth Circuit on behalf of our clients. We are frequently hired as “appeal counsel” to represent a client whose case has already been through the trial court and is now ready for the appeal process. Appellate procedure can be difficult and time consuming—your appeal should be pursued by an attorney who is familiar with working before the appellate courts. We are strong writers capable of preparing a brief that puts your best case before the appeals court. We also accept referrals from attorneys who find themselves too busy or too unfamiliar with the appellate process to feel comfortable pursuing an appeal on behalf of a client. If you find yourself in need of a team of strong writers familiar with the appeal process, call us.

+ Civil Rights Law and Government Liability Defense

Lawsuits alleging civil rights violations can be especially challenging. We regularly represent counties, municipalities, and school districts in these types of cases. The consequences in civil rights cases can be steep, and defending them requires experienced attorneys familiar with the law and procedure of constitutional and civil claims. We can provide just that. We have attorneys experienced in defending all types of civil and constitutional claims. Our firm possesses the know-how and resources to aggressively defend any governmental entity accused of a civil rights violation.

+ Criminal & Traffic Law

Few legal problems are as stressful as being accused of a crime.  If you are accused of a crime—whether it is a felony, a misdemeanor, or a traffic ticket—it feels like it’s you against the world. But remember, you are presumed innocent until proven guilty beyond a reasonable doubt.

Turn the problem over to us, and let us fight for you. No matter the severity of the crime you are facing, we make sure you get a fair shake against a big system. After all, our Constitution levels the playing field and cloaks you in a presumption of innocence.

The less serious cases, such as misdemeanors and traffic infractions, often jeopardize one of your most precious possessions—your driver’s license.  DUI, Driving While Suspended, Reckless Driving, or even too many speeding tickets can jeopardize your driving privileges. Together, we will fight for the best possible outcome.

Divorces can be an emotional and financial wrecking ball, especially if you have children.  You want to land on your feet after the divorce, but mostly you want your kids to do well in spite of the storm.

We care about you and understand your concerns. We will listen to you and fight for your fair share in a divorce proceeding. How property is divided, child support issues, and spousal maintenance issues can make or break your financial future.  Let us work you through this difficult time and fight for the best possible outcome.

We also handle other family matters:

  • Post-divorce issues such as child support adjustments, custody or parenting time issues
  • Prenuptual agreements

Employers have a lot to navigate in the legal field—federal laws, state laws, policies and procedures—all while trying to keep a business profitable and running efficiently. At McDonald Tinker, we help protect employers. We work with employers to draft policies that comply with the relevant laws and meet the specific needs of the company. We educate employers through seminars and can conduct training sessions with employees. Our goal is to help protect your company from potential claims and lawsuits. However, sometimes having to defend an employment law claim is simply a fact of doing business. If an employee does file a claim or lawsuit, we are experienced litigators with a track record of defending employers. We have defended employers accused of all types of discrimination, harassment, and wage/hour violations. If you find your company on the wrong side of a lawsuit, we can represent you and help you get back to what matters most—running your business.

Sometimes, employees’ rights are violated and they are subjected to treatment at work that is hostile, unfair, and in violation of the law. If you are an employee and feel your workplace rights have been violated, call us. We have experience representing employees subjected to unlawful discrimination and harassment in the workplace. The process of pursuing an employment law claim can be tricky and is not a road you have to walk alone.

+ Immigration Law

The immigration process is confusing, frightening and complicated. Whether you are seeking to enter the United States as a legal immigrant or are already in the United States and are facing deportation or need assistance with any other immigration related matter, McDonald Tinker can help. Angela Balderas is a Florida-licensed attorney with substantial experience in immigration law and can help you if you are seeking assistance or are facing serious, time-sensitive issues with respect to your immigrant status, including:

  • The U Visa: The U Visa is a nonimmigrant visa which is set aside for victims of crimes (and their immediate family members) who have suffered substantial mental or physical abuse and are willing to assist law enforcement and government officials in the investigation or prosecution of the criminal activity.
  • The T Visa: The T Nonimmigrant Status is a set aside for those who are or have been victims of human trafficking, protects victims of human trafficking and allows victims to remain in the United States to assist in an investigation or prosecution of human trafficking.
  • Deportation (also called “removal”) occurs when the federal government formally removes an alien from the United States for violations of a number of immigration or criminal laws, described in more detail below. Once deported, an alien may lose the right to ever return to the United States, even as a visitor.
  • Naturalization is the legal act or process by which a non-citizen in a country may acquire citizenship or nationality of that country. Citizenship is the status of a person recognized under the custom or law as being a member of a state. A person may have multiple citizenships and a person who does not have citizenship of any state is said to be stateless.
  • Deferred Action for Childhood Arrivals (DACA) is an American immigration policy that allows certain undocumented immigrants who entered the country before their 16th birthday and before June 2007 to receive a renewable two-year work permit and exemption from deportation.
